Jon Mitchell successfully defends sentence in Attorney-General’s appeal

Jon Mitchell successfully defended an Attorney-General’s reference under s. 36 of the Criminal Justice Act 1988 in respect of a sentence of 2 years’ imprisonment suspended for 2 years for digital anal penetration and associated assaults on arresting officers.

The Court of Appeal found that the sentence was correct in principle in the circumstances of the case, thereby approving of Mr Mitchell’s submissions on categorisation as advanced in his Sentencing Note, and rejecting the arguments put forward in the appeal by the Crown.
