The Court of Appeal has upheld the conviction of a man for causing or allowing the death of a vulnerable adult. Prosecuted by Stuart Trimmer KC, the case concerned the death of Shahena Uddin, following long term abuse and mistreatment at the hands of several of her family members. At the original trial, Ms. Uddin’s sister-in-law, Salma Begum, was convicted of her murder. Her sister and four of her brothers, including the appellant Uddin, were convicted of causing or allowing the death of a vulnerable adult. The Court of Appeal agreed with the Crown’s submissions that the definition of an ‘otherwise’ vulnerable adult included adults subject to particular forms of domestic violence and other controlling behaviour. The appeal was dismissed and the conviction upheld.
