Unexplained Wealth Orders (UWOs) are an enforcement tool available to the prosecuting agencies the SFO, NCA, HMRC, CPS or the FCA. UWOs are designed to enable the confiscation of the proceeds of crime by means of civil, rather than criminal, powers and can be sought before civil or criminal proceedings have begun.
Utilised when assets are inconsistent with the income level of their owner, Unexplained Wealth Orders (UWOs) require an individual to explain and account for the origin of their assets. Since their introduction in 2018 under the Criminal Finances Act 2017, they have proved far from straightforward. Those pursuing or defending a UWO require nuanced, expert legal advice.
4BB Chambers has considerable experience in advising both the prosecuting agencies and recipients of UWOs, as well as affected third parties, on every stage of UWO proceedings. We devise effective case management strategies and deploy skilled written and oral advocacy, drawing on our criminal law background and practical expertise in restraint orders, appeals, repatriation, confiscation and disclosure orders.
