Niamh Sexton secured the acquittal of her client charged with Possession of a Bladed Article, Assault by Beating and Criminal Damage.
The Crown sought to rely on the evidence of a deceased witness under the hearsay provisions. Niamh successfully opposed the application, advancing detailed submissions under Article 6 of the European Convention on Human Rights. The Prosecution ultimately offered no evidence.
Niamh also successfully argued that the bladed article offence could not be made out in law due to the location of the incident. Niamh’s client was acquitted of this charge after trial.
