James North secured the acquittal for his client charged with a racially aggravated public order offence.
The Crown’s case was that the Defendant directed racial abuse towards a police officer following a traffic stop. The incident was said to have been captured on the officer’s body-worn camera.
At the defendant’s first appearance before the Magistrates’ Court, he was already subject to an 18-month community order for offences committed during the same period. James successfully argued that the allegation should have been dealt with at the same time as those earlier matters, and that the delay in bringing proceedings would unfairly prejudice the Defendant if convicted.
Following a review of the case, the Crown offered no evidence and a not guilty verdict was recorded.
