Following a retrial at the Kingston Crown Court in May 2017, Charles Digby has secured has secured the acquittal of a man accused of causing GBH with intent to do so, who was alleged to have thrown acid into the face of his new girlfriend’s former partner. As a result of the attack, permanent eye damage was caused to the complainant. The girlfriend had argued with her former partner that day over contact arrangements with their child, ending the argument with “just wait and see”. Charles Digby, instructed by Caroline Spencer-Boulton, argued that the complainant, who had a history of Instability, may have self harmed or, if not, his ability to recognise the defendant was poor. Charles also demonstrated a partial alibi with disclosed CCTV evidence. Whilst the 1st jury took several days before they were deadlocked, the second jury acquitted the defendant in just over an hour.
