Tommy appears in the Crown Court on a daily basis. He has experience of defending those facing a wide range of criminal matters, including serious and domestic violence, drugs, sexual offences, robbery, extradition, offensive weapons, football-related offences and dishonesty offences. He is approachable and skilled in representing young and vulnerable defendants.
Tommy is regularly instructed in private driving matters: he represents and advises clients charged with serious motoring offences such as dangerous driving, as well as driving whilst unfit through drink and drugs. He is experienced in cases where clients are at risk of being disqualified from driving, conducting ‘exceptional hardship’ and ‘special reasons’ hearings.
The Defendant was acquitted of Possession with Intent to Supply Class B Drugs, with a street value of £750,000. The drugs were found concealed within cavities in the rear of the Defendant’s vehicle.
The Defendant was accused of Possession of an Imitation Firearm with Intent to Cause Fear of Violence and Possession of an Offensive Weapon. The Defendant was said to have produced an air pistol and discharged it ten times, whilst also being in possession of an old-style police truncheon. The Defendant was acquitted for both offences.
The Defendant was charged with Possession with Intent to Supply Class A Drugs, after 11.5 kilos of cocaine was seized by police. The Defendant initially faced a sentence with a starting point of 14 years’ custody. Following successful representations made, the Defendant received a sentence of 7.5 years’ imprisonment.
Led Junior in the defence of two Defendants in a five-hander trial relating to various charges of Rape and Indecent Assault, dating back nearly 30 years ago.
The Defendant was sentenced for Fraud by Abuse of Position, having transferred over £57,000 into his own personal bank account in his employment as a treasurer. The Judge was persuaded to defer sentence, before later imposing a sentence of 20 months’ imprisonment suspended for 18 months, with no requirements attached.
The Defendant was sentenced in respect of three counts of Causing Serious Injury by Dangerous Driving. Successful representations were made concerning the Defendant’s impairment following his consumption of nitrous oxide during the journey, ultimately resulting in a reduction from a starting point of 3 years’ custody to 1 years’ custody. The Defendant received a sentence of 1 years’ imprisonment, with the sentence appealed to the Court of Appeal in respect of suspending the term of imprisonment given the Defendant’s employment as a professional footballer.
The Defendant was acquitted of Assault on an Emergency Worker and Criminal Damage to a Police Officer’s watch. The Defendant was pursued and arrested by the officer following his refusal to provide details for a Coronavirus Fixed Penalty Notice. On the first day of trial, successful representations were made that the Defendant’s arrest was unlawful following the High Court decision in Neale v DPP [2021] EWHC 658 (Admin), whereby it held that the Appellant was not under a statutory obligation pursuant to the Coronavirus Regulations to give his name and address to the police. The Prosecution ultimately offered no evidence in respect of all charges.
The Defendant received a sentence of 20 weeks’ imprisonment at Southend Magistrates’ Court for various offences of Assaults on Emergency Workers. The Defendant appealed against sentence on the basis that it was manifestly excessive. The appeal was successful and the Defendant was made subject to a community order instead.
