Davina Mootien has over 10 years experience of conducting all aspects of criminal trials, both prosecuting and defending, being led by KCs and as junior alone.
Davina is a grade 2 CPS prosecutor with some grade 3 experience. She also advises and prosecutes on behalf of other authorities such as the Serious Fraud Office, Trading Standards, Probation, DWP and RSPCA. Davina has significant experience as led junior, prosecuting multi-handed serious, complex frauds involving voluminous case papers, disclosure and evidential issues, culminating in lengthy trials lasting over 3 months, against top Queen’s Counsel.
Examples of Davina’s successes in defending include securing an acquittal for a nurse charged with assaulting a special needs patient in her care. In a multi handed affray, hers was the only client acquitted following a trial at Harrow Crown Court. She also represented a young defendant, at trial in the Central Criminal Court. The defendant was found not guilty of a gang related robbery. Davina’s expertise in handling vulnerable witnesses and defendants was commended by the Judge, when she worked with a registered intermediary and defended a 15-year-old boy charged with a sexual offence on a 15 year old girl, with a diagnosed mental age of 5.
Davina has also worked in the field of public inquiries, for over 6 months, reviewing sensitive military statements regarding Iraqi detainees.
Davina has trained professional witnesses on giving evidence in court and has given talks to students at BPP Law school about life at the Bar. She is qualified under the direct access scheme in which members of the public can approach her chambers directly for advice and/ or representation in specific circumstances.
